We are not separatists! We are at home in our native Ruthenian land that with our consent and only in 1991 became part of Ukraine! The threat of ethnic elimination of the Ruthenian people since 1991 by the nationalist tandem Kiev-Lvov, the Ruthenian national survival instinct, which was triggered during the “Orange regime” in 2004-2010, have encouraged Ruthenian activists to resort to all sorts of measures and ways to protect themselves.. We seek the legal aid from the Czech Republic and the Russian Federation, as the legitimate successors to the USSR and Czechoslovakia (under Fierlinger-Molotov Treaty from June 29, 1945), and from governments around the world.
However, this peaceful and lawful Ruthenian movement for the restoration of pre-Soviet status of the Subcarpathian Ruthenia within Ukraine was provocatively called separatism by Kiev and Lvov. The Ukrainian authorities have attempted violent repression of this movement by administrative totalitarian "legal methods", namely, Article 110 of the Penal Code, which is not yet in force legally.
V. Yushchenko added an insult to the injury with regard to Ruthenian issue, when in March 2010 he issued a presidential decree about official recognition of "the independent state, Carpathian Ukraine" as from the 15th of March, 1939. In addition, previously he illegally awarded the title Hero of Ukraine to the Abwehr agent Alexander Voloshin, a citizen of Subcarpathian Ruthenia and Czechoslovakia.
Through this decree on the recognition and celebration of the "Carpathian Ukraine", Yushchenko further complicated the legal relationship between independent Ukraine and the territory of Ruthenians - Transcarpathian region. Recognizing independence of the State "Carpathian Ukraine" - Subcarpathian Ruthenia, separate from the Soviet Ukraine, proved the illegitimacy of the rule of Ukraine in the Ruthenian territory today. This Decree of President Yushchenko opens the way for the immediate restoration of the status of the Ruthenian state, which came into legal force after the demise of the Soviet Union in 1991. The peaceful solution to the Ruthenian issue is in direct interests of Ukraine.
However, simultaneously with the official recognition of the sovereignty of Carpathian Ukraine as from the 15th of March 1939, the Ukrainian government headed by Yushchenko reinforced repressions against Ruthenians, which confirmed the existence of criminal anti-Ruthenian policy in Ukraine, e.g. discrimination and ethnocide with clear signs of genocide. To justify his lawlessness, Yushchenko came up with the myth of separatism in Donetsk, Crimea and Transcarpathia, and ordered the SSU to fabricate criminal cases and "punish" the separatists. Therefore, there was, among others, criminal decision to open criminal case number 499 against the Ruthenian nation in June 2008, which was reopened in November 5, 2008, personally against the priest Dimitry Sidor, head of the association Soym of Subcarpathian Ruthenians.
Yushchenko lost the elections, but he managed to ship and to send uncontrollably (!!!) his enormous wealth to the U.S.A. At the same time the direct performer of these transactions and fabricant of the criminal case against Ruthenians, businessman Nalyvaichenko, being a multimillionaire, also disappeared from view with his "fair acquisitions". Initiated by them case number 499, as well as a "political quagmire", was inherited by their successors.
Your honour, Please note that after December 1, 1991, the decisions of the referendum on the restoration of the pre-Soviet status of Transcarpathia-Subcarpathian Ruthenia, acquired the force of the Act, binding on all branches of Ukrainian authorities, and should have been included to the Constitution of Ukraine in 1996. However, this did not happen because of Ukrainian nationalist government under the pressure of Lvov.
Therefore, now, Ukraine does not possess any legal rights of regency
in the Ruthenian state, and Ukrainian court has no authority to judge the inhabitants of Transcarpathia.
Over the last 19 years, I have also been denied basic civil and political rights by the Ukrainian authorities - the right to Ruthenian nationality, Ruthenian language, religion, culture, education, etc.
What else should Ukrainian court try me for in my native land, where Ruthenians feel like in a Ukrainian concentration camp, where the only recognised nationality is Ukrainian, all the rest are forced to study only Ukrainian language, and the rights of other nations are infringed, including the right to study the native mother tongue?
Due to the non-recognition of the results of 1991 referendum by Kiev, there is a threat of repetition of the annexation of the Ruthenian territory and the ethnic destruction of the peaceful Ruthenian political nation by the nationalist government of Ukraine (especially in the last reign Yushchenko and the “Orange powers“).
The population of Transcarpathia-Subcarpathian Ruthenia, 70% consisting of Subcarpathian Ruthenians, acquired and exercised their right to self-determination in the 1918-19. Ruthenian territory was forcibly joined to the Ukrainian SSR by "the brotherly people of the USSR", with the help of Soviet tanks and through the criminal actions of the NKVD.
Today Ruthenian people rose to the political struggle over the threat of ethnic death of their nation, dying Ruthenian language and culture, as well as complete disregard by Kiev of the Ruthenian statehood, restored on Dec. 1, 1991.
These facts forced the leaders of the Ruthenian organizations, legitimately defending their rights under international law, encourage Transcarpathian Regional Council to carry out their duties, and to proclaim the autonomous status of Transcarpathia, as well as appeal to the public around the world for an urgent legal assistance.
Under international law, violation of human rights and freedoms of the Ruthenian people is not solely an internal affair of the state of Ukraine.
United Nations in 2007 pointed out to the fact of discrimination of the Ruthenian nation on ethnic grounds in Ukraine, urging the authorities to take appropriate action.
However, instead of revising the shameful situation with the human rights in Ukraine, "Orange authorities" increased political repressions against Ruthenians and their leaders, and launched legal proceedings against them.
Transcarpathian Regional Council and the Ruthenian organizations in many letters of appeal, written to the highest authorities of Ukraine, peacefully announced that they are not separatists and they act according to international law. Ruthenians also reminded to the Ukrainian authorities that peaceful coexistence and prosperity for the peoples of the state is impossible, if it does not comply with its obligations to other nations and states, but takes the path of discrimination and ethnocide of the national minorities instead.
Republic of Subcarpathian Ruthenia-Transcarpathian Ukraine, which became part of the USSR not willingly, but by the will of the winners of the war of 1941-45, is the State, to which Ukraine, Czech Republic, U.S., EU and Russia still have not fulfilled their international obligations.
Recognised in the world until 1945, the State Subcarpathian Ruthenia was illegally annexed to the USSR - Ukrainian SSR in June 1945. Later, in 1946, Stalin, Khrushchev and Ukrainian Communists illegally deprived Subcarpathian Ruthenia of its status of an independent state, its right to self-determination, with the subsequent ban of the Ruthenian national identity.
Ruthenians then suffered the consequences of their unfair annexation by Stalin and Ukraine, and the illegal decision of the Supreme Soviet of the Ukrainian SSR about transformation of Subcarpathian Ruthenia into "Stalin’s anomaly", Transcarpathian region.
What does the Ukrainian machine of propaganda hide from its citizens? Ruthenians became part of Czechoslovakia on 10.09.1919, already being autonomous!
During the Soviet-Ukrainian times, and today, in the new Ukrainian times, the authorities have been actively concealing from the public that on the 21st of December, 1918, according to the Law № 10 of Hungary, autonomous (of Hungary) Ruthenian Republic "Ruska Krajna" freely seceded from Hungary, and freely became part of Czechoslovakia in Sept. 10, 1919, with the status of autonomy and the constitutional name “Subcarpathian Ruthenia.” This happened according to the will of the Ruthenian people and the decision of an international treaty of Saint-Germaine, according to which the Ruthenian political nation and Subcarpathian Ruthenia gained inalienable and indefeasible status of a subject of international law.
The member countries of the Paris Peace Conference had agreed to such accession. In article 53 of the Saint-Germaine peace treaty with Austria, on 09.10.1919, was stated that Czechoslovakia acceded only "independent territory of the Ruthenians to the south of the Carpathians", i.e. territory of the autonomous Ruska Krajna - Ruthenian country, because the territory of the Ruthenians of Pryashivska Ruthenia was already recognized as an integral part of Czechoslovakia. The territory of Galicia was returned by Europe to Poland.
Conditions of accession of the autonomous Ruska Krajna - Ruthenian country to Czechoslovakia were distinctly predetermined by participating countries of the Paris Peace Conference, as well as by the agreement with Czechoslovakia of 9.10.1919, which was named "Protection of Minorities". In particular, the 11th paragraph of this international treaty on the protection of minorities read, - “Krajna - the country of the Ruthenians to the south of the Carpathians will have a separate Soym, i.e. autonomous national parliament.” The 13th paragraph stated, - “Czechoslovakia provides to Krajna - Ruthenian country proportional representation in Parliament of the Czechoslovak Republic.”
Ever since, 90 years ago, not just any Ruthenians, but Subcarpathian Ruthenians, or, according to the text of the treaty, Ruthenians in the "territory to the south of the Carpathians" - evolved into a political nation and became the state-forming nation, who exercised their legally acquired right to self-determination as part of Czechoslovakia.
So far, no one legitimately deprived Subcarpathian Ruthenians, residents of “the territory to the south of the Carpathians”, of this right. While at least few Ruthenians are still alive, they are successors of this right to self-determination in their independent territory. According to statistics, today there are over 700,000 Ruthenians. This fact is being hidden from its citizens and the world public by the authorities of Ukraine, who are trying to prove that the Ruthenians whether do not exist, or they are in fact Ukrainians.
Your honour, It is no secret, and there is a proof on your desk that the Republic of Subcarpathian Ruthenia in November 22, 1938, along with Slovakia and the Slovak people, were lawfully made legitimate within the Federal Czechoslovakia, where officially existed all three national anthems, Czech, Slovak and Ruthenian, along with three national flags and three national emblems. The status of Subcarpathian Ruthenia was not questioned by anyone in the world up until now.
Today part of the state attributes of Subcarpathian Ruthenia were restored by the Regional Council, including the Ruthenian national anthem "Subcarpathian Ruthenians, arise from your deep slumber…", which once again proves the viability of the Ruthenian people, their national integrity and awareness of their legacy.
The division of Czechoslovakia by Hitler in 1939 was a tragedy, including for the state Subcarpathian Ruthenia.
In Ukraine, very few people know that the Subcarpathian Ruthenians were victims of the illegal separation of Czechoslovakia by Hitler, which took part on the 14th of March 1939. At the time, Abwehr held its special operations, planned in Berlin - the so-called proclamation of "Independence of Slovakia and Subcarpathian Ruthenia from the Czech Republic." Abwehr used its agents (actually international terrorists from among the Galician nationalists), who illegally provoked a precedent of the proclamation of "Carpathian Ukraine" in March, 15, in fact, being citizens of Poland, and as such, not having the right to do that. Clearly, Hitler, who planned his march against the Russians, could not stand in his way the anti-fascist Subcarpathian Ruthenia, headed by anti-fascist Prime Minister Andrew Brodie, who was slandered by Berlin, and replaced by its protégé Augustin Voloshin.
Historians and lawyers have called this proclamation of "Carpathian Ukraine" on 14-15th of March 1939, an adventure of Galician nationalists carried out by Voloshin.
The attempted coup also ended in failure for the Galician terrorists. Thousands of illegal immigrants from Galicia were killed, wounded and captured.
It should be remembered that the attempt of the coup in the Subcarpathian Ruthenia in March 1939, carried out by Abwehr and pro-Galician wing of Carpathian Sich, had failed. Ruthenians had rebuffed Polish citizens, illegal immigrants from Galicia.
By the way, according to the documents of registration, Czechoslovak Carpathian Sich was founded "to support the Subcarpathian Ruthenia and its government." However, thousands of illegal migrants from Galicia, who entered into it, very quickly turned it into their storm troops under the leadership of the Abwehr officers.
At that time there was a real threat of ethnic cleansings of Ruthenians and Hungarians coming from Galicia.
We should not lose of our sight the fact that the coup attempt, although unsuccessful, harboured
the danger of ethnic cleansing of Ruthenians and Hungarians. That was what triggered the sudden occupation of the Ruthenian territory by Hungary in the March 14, 1939, whose authorities have stated that they had provided the autonomy to the Ruthenians 20 years ago, and therefore presence of the citizens of Poland in the power had been illegal.
The Hungarian occupation was not tragic for the Ruthenians at the time, because Hungarians had suspended the activities of illegal Polish-Galician terrorist groups in the territory of Subcarpathian Ruthenia, transferring prisoners from Galicia to the Polish authorities. Neither the Ruthenians, nor Hungarians are to blame for the fact that the Poles shot their citizens, immigrants from Galicia, relegating them deep into Poland.
So why today they set to them monuments in the territory of Transcarpathia for the money of the Ruthenians?!
Hungarians have always maintained respect for the Ruthenian culture. Hungary, who provided Subcarpathian Ruthenians with autonomy 20 years ago, according to its leaders, could not tolerate the destruction of the Ruthenian national state by the hands of Galician-Polish forces of Abwehr. For this purpose, the Hungarians held a census in their territory, and in the territory of Subcarpathian Ruthenia, according to which there were 506,000 Ruthenians and two hundred Ukrainians - immigrants from Polish Galicia.
Census in the territory of Subcarpathian Ruthenia in 1941 confirmed the adventurous nature of the proclamation of independence of "Carpathian Ukraine" by Galicians, even so, with the introduction of the Ukrainian language as a state language, and Austrian blue-yellow flag in favour of two hundred of Ukrainians-illegal immigrants.
Soviet NKVD-ists annexed Subcarpathian Ruthenia in 1944-46, and became "brothers" with Galician terrorists-illegal migrants.
Further acts of the Soviet leaders were also illegal. In November 26, 1944, under the leadership of the NKVD, they held the first (and last) Congress of People's committees in the territory of Subcarpathian Ruthenia, which was in fact part of Czechoslovakia, in the combat zone in Mukachevo, which imposed following decisions:
a) Accept the Moscow "Manifesto" on reunification of Transcarpathian Ukraine with the "mother-USSR";
b) Change the name of the Republic of Subcarpathian Ruthenia into "Transcarpathian Ukraine";
c) Introduce a second state language - Russian;
d) Introduce state red flag of the USSR;
d) Declare secession of the state from Czechoslovakia.
" Transcarpathian Ukraine" existed in the status of an independent state from November 26, 1944 to January 22, 1946; i.e. more than a year, with the existence of its own parliament - the People's Parliament, international trade (with the USSR), its courts, police, banks, currency, and Post offices.
Subsequently, on June 29, 1945, according to the treaty between the Soviet Union and Czechoslovakia (known as the Fierlinger-Molotov Treaty), Subcarpathian Ruthenia as a sovereign state with the name of Transcarpathian Ukraine was illegally annexed by the Soviet Union. Moreover, this took place without the will of the Ruthenian people and the consent of their Commissioners.
Even before the ratification and entry into force of this unlawful agreement on Jan. 31, 1946, USSR, in the face of the Communist Parliament, on January 22 blatantly annexed the territory of the Republic of Subcarpathian Ruthenia. To prevent from coming into force the agreement that Transcarpathian Ukraine-Subcarpathian Ruthenia was a sovereign state, Ukrainian Communists turned it into an administrative area.
With the aid of this illegal decree of the Supreme Council, the Ukrainian Bolsheviks formed on the territory that did not belong to them their administrative region called "Transcarpathian region", also implementing on its territory their legislation.
As a result of this apparent annexation, the sovereignty of the Subcarpathian Ruthenia-Transcarpathian Ukraine was violated, and was resumed de jure only after the demise of the Soviet Union in 1991.
Similarly, the statehood of Poland was violated through its division between Germany and the Soviet Union in August 1939, under the Molotov-Ribbentrop pact. However, after the demise of Germany and the USSR, Poland regained its statehood without further referendums.
Knowing this, Kiev and Lvov refuse to admit that after the Soviet Union (to which in June 29, 1945 was forcibly and illegally annexed the sovereign state Republic of Subcarpathian Ruthenia under the name of Transcarpathian Ukraine) ceased to exist, Subcarpathian Ruthenia (the Republic, formed in 1918) automatically resumed its pre-Soviet status.
Ruthenian political nation has the right to self-determination. In the face of the Transcarpathian Regional Council, after the demise of the Soviet Union, our people decided to hold a referendum on Dec. 1, 1991, on whether to remain a separate sovereign state, Subcarpathian Ruthenia, or support the new state "independent Ukraine" and join it on the rights of the pre-Soviet status of an autonomous state.
Thus, according to results of the referendum on December 1, 1991, which automatically became law of Ukraine, the Republic of Subcarpathian Ruthenia decided to join the new Ukraine with the status of autonomy.
According to the text of the referendum, the territory of Ruthenians was a "special self-governing territory and the subject of law in Ukraine, not included in other administrative-territorial entities."
However, instead of gratitude for the confidence in Ukraine, nationalist tandem of Kiev and Lvov for nearly 20 years blatantly denied Ruthenians in recognition of their legitimate right to implement the results of the referendum. Thus, in violation of international law, the Ukrainian authorities prevented the introduction of the State Subcarpathian Ruthenia in the legal field of the new Ukrainian state, i.e. the Constitution of 1996, as reconstituted in its status of an independent republic. Anti-Ruthenian aggressive policies of the nationalists have threatened the stay of Transcarpathia - Subcarpathian Ruthenia, sovereign republic, within the new Ukraine. So far, following the requirements of a secret criminal state "Plan of actions…" on ethnic elimination of the Ruthenian nation, intelligence agencies and prosecutors subjected Ruthenians and their leaders to incessant repressions for their legitimate claims of their unique rights.
It is obvious that the higher authorities of Ukraine are aware of the real rights of the Ruthenian political nation and its unique legal heritage. Therefore, they are waging against Ruthenians "a life or death war", through controlled scientists, historians, lawyers, and intelligence services.
Galician nationalists, who have never had similar legal heritage, while being a part of Poland, know about this right of the Ruthenians as well. Their adventure of forever reunion of Western Ukrainian People's Republic with the communist Ukrainian People's Republic in 1919, led them into politically stalemate trap.
Indeed, Lvov sees itself Piedmont of the Ukrainians, while realizing the futility to remain part of Ukraine on the rights of second-class city and region.
Therefore, nationalists from Galicia, having examined the legal rights of Subcarpathian Ruthenians and their right to self-determination, have decided to contest such right at any cost, beginning with their presence in Khust as storm troops during Hitler's proclamation of "the independent Carpathian Ukraine", as part of Czechoslovakia in March 1939. Being illegal migrants from Poland and international terrorists, they attempted coup and seize power, provoking a confrontation against the Czechoslovak and Hungarian troops. They put schoolboys-Ruthenians from Khust under the bullets of the Hungarian troops, while they ignominiously fled to Prague and Berlin themselves.
That is why the status of "Transcarpathian Ukraine, following the" Carpathian Ukraine” on Nov. 26, 1944, is not suitable for Galicians.
Status of "Transcarpathian Ukraine" proclaimed in the 26th of November 1944, with the following secession from the CSR, is not suitable for Galicians today, because of implementation of the Russian language as a second state language, and the red communist flag.
In the formation of a sovereign "Transcarpathian Ukraine" in the 26th of November 1944, using not Hitler’s but Stalin’s authority, the Ukrainian Galician Communists, and in the present "Orange" nationalists, present the Subcarpathian Ruthenians, legal holders of sovereignty, as Ukrainians, like themselves, in everyway impeding legal recognition of the Ruthenian nationality in Ukraine.
Significantly, the Galicians annually celebrate in Khust Anniversary of "Carpathian Ukraine", just to keep the Ruthenian region, which does not belong to them, but which they systematically rob.
It is well known, that the local Ruthenian people do not attend this celebration.
However, this is not enough. Now Lvov and Kiev decided to be through with the Ruthenians.
Hoping with the help of administrative and repressive methods to solve (or rather eliminate) Ruthenian issue, deputies of the Supreme Council, representatives of Galicia, in 1996, illegally prevented the inclusion the results of the 1991 referendum on restoration of the pre-Soviet status of the Ruthenian state to the Ukrainian Constitution.
Becoming the citizens of the Ukraine instead of Polish citizens by the will of Stalin, they come in a rage, jealous of such a recognized right of the Subcarpathian Ruthenians.
It is them, rather than including the people's will in the Constitution, initiated the "Plans of actions…" designed to destroy Ruthenians.
That is why, instead of implementing the Law of Ukraine, which was the result of the referendum of Dec. 1, 1991, about the restoration of pre-Soviet status of the Ruthenian state, Galicians through the authorities of Ukraine, in the same 1996 advanced their criminal government anti-Ruthenian "Plan of actions to address issues of the Ruthenians-Ukrainians". They prescribed in details the "obligations" for academic institutions, security services, court, prosecution, police, and local administration, the procedures and terms of ethnic destruction of the Ruthenian political nation.
Galicians through criminal "Plans of actions…" on ethnic elimination of the Ruthenian nationality in 1996 forced the Ukrainian scientists to "prove" that "Ruthenians do not exist", that "they are just sub-ethnic group of Ukrainian people", and "Ruthenians - is the old name of the Ukrainians." Then, demanding solutions of the Ruthenian issue, they refer to the scientists, controlled by them, stating that "recognition of the Ruthenians is unscientific!"
How void of understanding the Ukrainian science is, if the Ukrainian authorities in the face of nationalist-minded outsiders can dictate to it what nation should be recognized, and what should not!
Your honour, The statehood of the Republic of Subcarpathian Ruthenia was
restored in 1991 because of the demise of the Soviet Union.
Since the status of statehood of the Republic of Subcarpathian Ruthenia was restored with the demise of the Soviet Union and confirmed by the results of the referendum of Dec. 1, 1991, but Ukrainian nationalist government flagrantly ignored the will of our people, the annexation of the Ruthenian state was repeated by the government of independent Ukraine. As we know, the first annexation of the Subcarpathian Ruthenia by Kiev took place on January 22, 1946.
Such criminal anti-Ruthenian actions of the Ukrainian authorities forced the leaders of the Ruthenian organizations defend themselves by all legitimate means.
Ruthenian organizations exist already for over 20 years, from 1989 to the 90-s. Today Ruthenian movement is represented mainly by two associations: Soym of Subcarpathian Ruthenians and the People's Council of Transcarpathia. There are also other organizations.
It is evident already that the Ruthenian movement cannot be stopped merely by repressions.
Failure to recognize the Ruthenian nation by Kiev creates the most dangerous precedent for Ukraine - a real threat of separatism and powerful opposition!
I am being tried because in Oct. 25, 2008, in Mukachevo was peacefully adopted regular
Ruthenian Memorandum, as a formal reminder to Kiev about the rights of the Ruthenians. At the same time has also been collectively adopted the Act of formal confirmation of the declaration of the Ruthenian state, declared in December 1, 1991, and confirmed in December 1, 2008, when was also elected the shadow Ruthenian government. Our objectives are: restoration of the legitimate rights and freedoms of the Ruthenian political nation, prevention of the nation from ethnic destruction, implementation of the results of the referendum of Dec. 1, 1991, which had re-established Ruthenian state.
This circumstance led the leaders of the Ruthenian organizations to work together, despite the unprecedented fighting of SSU agents within Ruthenian movement on an artificial split within the Ruthenian community.
Seeing that the "Orange power" loses credibility in the country, Yushchenko and Nalyvaichenko created myth of "separatism in Donbass, Crimea and Transcarpathia for the money from Moscow". Based on this myth, the SSU had received orders to initiate criminal cases on false charges, carry out political repressions against the Ruthenians, bring in a group of Ukrainian Galician nationalists, who have been publicly flouting the rights of the Ruthenian nation, and inflaming interethnic strife in Transcarpathia.
By the way, according to media reports, UNA-UNSO at the reign of Kuchma, as well as "Svoboda” at the reign of Yushchenko acted cohesively as certain branches of intelligence services, acting on their orders, as if "on behalf of the people".
Such aggressive actions of SSU and their affiliates, representatives of the party "Svoboda", encouraged Ruthenians to elect a shadow government at the 2nd European Congress of Subcarpathian Ruthenians in Mukachevo in October 25, 2008, the forum that brought together Subcarpathian Ruthenians, scattered across Europe and the Russian Federation.
Status of the Ruthenian shadow government was confirmed by the first World Congress of the Subcarpathian Ruthenians in Pardubice in the Czech Republic in April 2009, and later by the European Ruthenian Congresses in 2010.
The individual statements of some Ruthenians, dictated by the intelligence services,
that the "Ruthenian government is illegal, because it was not elected in a referendum", are futile.
The government of the Ukrainian People's Republic, proclaimed by the Austrian national B. Hrushevsky in 1919 in Kiev, and unrecognized in the world, was not elected as well, but it was operating, and engaging in formal relations with Germany and other countries.
Proclamation of Western Ukrainian People's Republic in 1919 by the bunch of terrorists no one in the world recognized either. However, they reigned and even made a symbolic act of "reunification of the Ukrainian National Republic and Western Ukrainian People's Republic", which was not recognized as legitimate.
The threat of ethnic elimination inspired Ruthenians to take actions for their protection.
Today Ruthenian political nation, and its "autonomous territory to the south of the Carpathians", has the right to self-determination, having acquired in 1919 status of a subject of international law. After intervention of the Galician units in the affairs of Subcarpathian Ruthenia in 1939, the annexation of the autonomous "territory of the Ruthenians to the south of the Carpathians" by Soviet Ukraine in January 1946, it was threatened new destruction by the Galician fascism in the new Ukraine. This is why we have every right to protect ourselves by any lawful means in the face of our representatives - Ruthenian organizations. Ruthenian organizations do not need to pay attention to the Security Service agents, who initiate conflicts, division and provocative statements about separatism.
Your honour, it is well known that when being faced with danger of national destruction, all the means of self-protection are authorized by international law, including armed resistance. Today, no one condemns the Croats, because they regained their right to
self-determination and proclaimed independence from Serbia.
According to my valuation information, today Ruthenian government as continuity from the preceding one, in early 2010, rightfully addressed personally to the governments of EU countries, each deputy of the State Duma of Russia, and personally to each Congressman of the United States, the package of documents asking for assistance in the rescue from the threat of destruction of the Ruthenian people in Ukraine.
Also followed a request for international recognition of the reconstituted state of the Republic of Subcarpathian Ruthenia in December 1, 1991, as we further reminded Kiev in the Memorandums of the European Congresses of Ruthenians in Mukachevo
in 2008-09.
Political repressions and prosecutions of the Ruthenians were initiated because of these Ruthenian Congresses and Memorandums.
Ruthenian organizations and shadow government, commissioned by the Congresses, appealed to the leaders of the EU, U.S., and especially to the Czech Republic and the Russian Federation, as successors to the USSR and Czechoslovakia, and to the treaty on the Carpathian Ukraine - Subcarpathian Ruthenia, to be the guarantors of the settlement of the Ruthenian issue - the recognition of the restored in 1991 Ruthenian state, saving the Ruthenian people from destruction, and rescuing Ruthenian language and culture.
Ruthenians emphasize that the Ruthenian issue can be resolved through peaceful recognition of the legitimate restoration of the statehood of the Republic of Subcarpathian Ruthenia.
Considering geopolitical situation, Ruthenians understand that they need an active, peaceful cooperation with neighbouring peoples and countries for the common good and future destiny of the European Union and the world!
Ruthenians are ready for constructive dialogue.
However, Kiev has completely deprived Ruthenians of this possibility, arguing on behalf of some members that they will not communicate with the separatists, but only with "good Ruthenians."
However, without mutual recognition, Europe and the world has no future!
Without recognition of International Law and Ruthenian political nation by Ukraine, it might find itself on the verge of collapse, like a boomerang to hit a totalitarian state.
Kiev will reap the same rewards that it sows, urged by pro-fascist organizations from Galicia.
It is true that the new President of Ukraine Viktor Yanukovych, who endured obstruction of the previous "Orange regime", presumably would not dare to repeat the mistakes of his predecessor, Viktor Yushchenko, and would provide the country with the opportunity of true democracy in the interests of all nationalities, not only Ukrainian.
At the same time, always bubbling Nazi-fascist Lvov, which hates democracy and human rights, is unlikely to be ready for a new peaceful relationships between peoples of Ukraine.
Subcarpathian Ruthenians, rejecting accusations of separatism, sow peace and mutual respect. Ruthenians, respectful of the rights and freedoms, are truly European nation, regardless of what type of assessment they were given by the fascist political Galicians, secret enemies of Ukraine!
Ruthenians, for consistency of their work, organized the Coordinating Council of Ruthenian Organizations and the Regional League of Nationalities. Ruthenians are confident in the implementing of the results of the referendum of Dec. 1, 1991.
Ruthenians are not separatists! We are at home!
Ruthenians do not recognize their forcible annexation to the USSR in June 29, 1945. That is what we must remember when subverting Galician myths that "Transcarpathia is the Ukrainian land originally" and "Ruthenians - is an old name for all Ukrainians."
We legitimately argue that Transcarpathia, or Subcarpathian Ruthenia is the Ruthenian territory that became part of Ukraine only in December 1, 1991, and only on the condition of the restoration of its pre-Soviet status.
Ignorance of that fact does not release the Ukrainian officials, politicians and law enforcement agencies from responsibility for violations of human rights and crimes against humanity.
We affirm the court and the Ukrainian authorities that almost 20 years of the official criminal resistance of the Ukrainian authorities to implement political and national rights of the Ruthenians is a crime against humanity, an ethnocide on the verge of genocide, and will be under the jurisdiction of The Hague!
That is why we, Ruthenians, reject any accusations of separatism at a time when the Ukrainian authorities are engaged in ethnic destruction of our people!
Only by implementation of the will of the people, expressed in the referendum of Dec. 1, 1991, the recognition of the rights of the Ruthenian political nation, a public apology of Kiev for 20 years of ethnocide of the Ruthenian nation and its discrimination with clear signs of genocide, can restore peaceful mutual relations.
There is no other way possible! We repeat that Ukrainian court has no right to judge the citizens of Transcarpathia, while their own volition was not yet implemented.
Any political repression and prosecution, which began in Ukraine against the Ruthenians, are illegal actions of the occupying authorities over the population of the occupied territory, and the court and prosecutors become concentration camp overseers, rather than those institutions, which should guarantee a fair solution of the Ruthenian issue!
